January 21, 2020 by , , , , , and

This is the final post of our six-part series summarizing significant legislative changes in labor and employment law for 2020.

PUBLIC SECTOR LABOR & EMPLOYMENT

AB 378 – Family childcare providers: Bargaining representative

This bill authorizes family childcare providers to form, join, and participate in the activities of a labor organization that has been certified by PERB as the representative of such providers in an appropriate unit. Certification will be provided through a PERB election after a 10-percent showing of interest is submitted in a certification petition. If any state entity or affiliated contractor chooses to hold in-person preservice meetings or orientations, that entity must provide the provider organization with access to such meetings and the ability to make a presentation about the organization and its activities. Likewise, if any state entity or affiliated contractor chooses to disseminate certain mass communications to providers or subsidy applicants, the Governor, through his representative, must meet and confer with the certified labor organization concerning the communication.
